13. "User-Generated Content"

"User-Generated Content" or "UGC" means any information, text, photographs, graphics, videos, audio recordings, logos, comments, reviews, ratings, articles, blogs, event details, advertisements, profile information, messages, documents, listings, or any other material that is uploaded, submitted, published, shared, transmitted, displayed, or otherwise made available by a User through the Platform.

User-Generated Content remains the responsibility of the User who submits it. Siliguri Circle does not automatically verify the accuracy, legality, completeness, originality, or authenticity of such content.

14. "Marketplace"

"Marketplace" refers to any present or future section of the Platform that enables Users or Businesses to buy, sell, promote, advertise, exchange, reserve, book, rent, or otherwise offer goods or services.

Unless expressly stated otherwise, Siliguri Circle acts solely as a digital intermediary and does not become a buyer, seller, distributor, manufacturer, importer, exporter, retailer, reseller, or agent in any transaction conducted through the Marketplace.

15. "Premium Membership"

"Premium Membership" means any paid or subscription-based membership, verification badge, promotional package, enhanced profile, featured placement, advertising plan, or premium service that may be introduced by Siliguri Circle in the future.

Premium Membership may include additional benefits, features, visibility, marketing tools, analytics, networking opportunities, or exclusive services subject to separate pricing and applicable terms.

16. "Services"

"Services" means all current and future products, digital features, community programs, networking tools, directories, communication systems, advertising solutions, event management services, membership programs, marketplace services, educational resources, promotional opportunities, mobile applications, APIs, and other functionalities offered through the Platform.

17. "Advertiser"

"Advertiser" means any individual, business, organization, agency, institution, sponsor, or third party that purchases, publishes, promotes, sponsors, or distributes advertisements, promotional campaigns, featured listings, banners, sponsored content, or marketing materials through the Platform.

18. "Intellectual Property"

"Intellectual Property" includes all copyrights, trademarks, service marks, trade names, domain names, logos, designs, databases, source code, software, trade secrets, business methods, patents, know-how, proprietary information, visual identity, branding elements, documentation, and all other legally recognized intellectual property rights existing now or in the future.

19. "Personal Data"

"Personal Data" means any information relating to an identified or identifiable natural person, including but not limited to name, address, email address, telephone number, date of birth, profile photographs, location information, device identifiers, IP addresses, account details, payment information, government-issued identification documents, or any other information defined as personal data under applicable laws of India.

20. "Cookies"

"Cookies" refer to small text files, device identifiers, pixels, web beacons, scripts, local storage objects, and similar technologies used by the Platform to recognize Users, remember preferences, improve performance, enhance security, analyze traffic, personalize content, and provide a better browsing experience.

21. "Applicable Law"

"Applicable Law" means all statutes, regulations, rules, notifications, ordinances, judicial decisions, governmental directives, and legal requirements that apply to the Platform or its Users, including the laws of the Republic of India and any relevant state laws, together with future amendments or replacements.

22. "Force Majeure Event"

"Force Majeure Event" means any event beyond the reasonable control of Siliguri Circle that prevents or delays the performance of its obligations, including but not limited to natural disasters, floods, earthquakes, cyclones, pandemics, epidemics, fires, explosions, power failures, cyberattacks, hacking incidents, internet outages, strikes, labour disputes, riots, civil unrest, acts of terrorism, war, governmental restrictions, judicial orders, or failures of third-party service providers.

23. "Platform Policies"

"Platform Policies" include these Terms and Conditions together with the Privacy Policy, Cookie Policy, Community Guidelines, Membership Rules, Advertising Policy, Marketplace Policy, Event Guidelines, Copyright Policy, and any additional policies, notices, standards, or procedures published by Siliguri Circle from time to time.

24. Interpretation

1. Words importing the singular include the plural and vice versa.
2. Words importing one gender include every gender.
3. Headings are provided solely for convenience and shall not affect the interpretation of these Terms.
4. References to statutes or legislation include any amendments, replacements, re-enactments, or successor legislation.
5. References to "including" or "includes" shall be interpreted as "including without limitation."
6. If any definition conflicts with applicable law, the applicable law shall prevail only to the extent of such conflict.
7. These definitions shall continue to apply after suspension, termination, or expiration of a User's Account wherever necessary to give effect to these Terms.

Acceptance of Terms

These Terms and Conditions constitute a legally binding agreement between Siliguri Circle ("Siliguri Circle", "we", "our", or "us") and every person, organization, institution, business, visitor, member, advertiser, or other entity ("User", "you", or "your") that accesses or uses the Platform in any manner.

By visiting, browsing, accessing, registering, creating an account, submitting information, publishing content, listing a business, joining a community, attending an event, purchasing services, or otherwise using any feature of the Platform, you acknowledge that you have carefully read, understood, and voluntarily agreed to be legally bound by these Terms and all other applicable Platform Policies.

4.1 Binding Agreement

Your continued use of the Platform constitutes your express acceptance of these Terms. If you do not agree with any provision contained herein, you must immediately discontinue your use of the Platform and refrain from accessing any of its services.

These Terms apply regardless of whether you are:

• A casual visitor browsing the Platform.
• A registered member.
• A citizen maintaining a personal profile.
• A business owner or representative.
• An advertiser or sponsor.
• An event organizer.
• A service provider.
• A volunteer or moderator.
• An organization or institution.
• A future premium member.

4.2 Acceptance by Conduct

Acceptance of these Terms may occur through any action demonstrating your intention to use the Platform, including but not limited to:

• Creating a user account.
• Logging into an existing account.
• Submitting registration forms.
• Publishing a citizen profile.
• Creating a business listing.
• Posting reviews or comments.
• Uploading photographs or videos.
• Registering for events.
• Sending messages through the Platform.
• Using community networking features.
• Purchasing premium services.
• Using any future functionality introduced by Siliguri Circle.

Each of the above actions shall constitute your unconditional acceptance of these Terms.

4.3 Additional Policies

These Terms should be read together with all other policies published by Siliguri Circle, including but not limited to:

• Privacy Policy
• Cookie Policy
• Community Guidelines
• Membership Rules
• Advertising Policy
• Marketplace Policy (where applicable)
• Event Participation Guidelines
• Copyright Policy
• Any future policies, notices, or legal documents published on the Platform.

In the event of any conflict between these Terms and a service-specific agreement, the service-specific agreement shall prevail only to the extent of that specific service.

4.4 Amendments to the Terms

Siliguri Circle reserves the right to modify, revise, replace, update, or remove any provision of these Terms at any time without prior notice, except where notice is required under applicable law.

Updated Terms shall become effective immediately upon publication on the Platform unless otherwise stated. Continued use of the Platform after such publication constitutes acceptance of the revised Terms.

Users are encouraged to review these Terms periodically to remain informed of any changes.

4.5 Electronic Acceptance

You agree that your electronic actions—including clicking buttons such as "Register," "Sign Up," "Login," "Continue," "Accept," "Submit," or any similar action—constitute your legal signature and have the same force and effect as a handwritten signature under applicable Indian law.

You further agree that electronic records maintained by Siliguri Circle relating to your acceptance of these Terms shall be admissible as evidence in any legal or administrative proceeding, subject to applicable law.

4.6 Continued Acceptance

Your acceptance of these Terms is continuous throughout your use of the Platform. Every subsequent login, visit, submission, transaction, interaction, communication, or use of any feature shall constitute renewed acceptance of the most current version of these Terms.

4.7 Legal Capacity

By accepting these Terms, you represent and warrant that:

• You have the legal authority to enter into a binding agreement.
• All information provided by you is true, accurate, and complete.
• You will comply with all applicable laws and regulations.
• Your use of the Platform does not violate any contractual, legal, or fiduciary obligations owed to any third party.
• You shall not use the Platform for any unlawful, fraudulent, or unauthorized purpose.

4.8 Refusal of Access

Siliguri Circle reserves the absolute right, at its sole discretion and without assuming any obligation, to refuse access to the Platform, reject registrations, deny membership applications, suspend services, or restrict access to any feature where it reasonably believes that such action is necessary to protect the integrity, security, reputation, or lawful operation of the Platform, its Users, or the wider community.

4.9 Entire Acceptance

By using Siliguri Circle, you acknowledge that you have read these Terms in full, understood their legal effect, and voluntarily agree to be bound by every provision contained herein. If you do not agree with any part of these Terms, you must immediately discontinue all use of the Platform.

Part 5 – Eligibility

Access to and use of Siliguri Circle is intended only for individuals and organizations that are legally capable of entering into binding agreements under applicable law. By accessing or using the Platform, you represent and warrant that you satisfy the eligibility requirements set forth in this section and will continue to do so throughout your use of the Platform.

5.1 Legal Capacity

You may use the Platform only if you possess the legal capacity to enter into a valid and enforceable contract under the laws of the Republic of India or the laws applicable in your jurisdiction.

By creating an account or using any service provided by Siliguri Circle, you represent and warrant that:

• You are legally competent to enter into binding agreements.
• You are not prohibited by any applicable law from using the Platform.
• All information submitted by you is accurate, complete, and truthful.
• You will promptly update your information whenever necessary.
• Your use of the Platform complies with all applicable laws and regulations.

5.2 Minimum Age Requirement

The Platform is intended for users who are at least 18 years of age.

Individuals below the age of eighteen (18) may use the Platform only under the direct supervision and consent of a parent or legal guardian, where permitted by applicable law. Siliguri Circle reserves the right to request proof of age or guardian consent at any time.

If Siliguri Circle discovers that an account has been created in violation of this requirement, the account may be suspended or permanently removed without prior notice.

5.3 Eligibility of Businesses and Organizations

Businesses, startups, educational institutions, government agencies, non-profit organizations, clubs, societies, resident associations, and other entities may create profiles or listings only through an authorized representative who has the legal authority to act on behalf of such entity.

By creating or managing a Business Profile or Organization Profile, the representative confirms that:

• They possess the authority to represent the entity.
• The information provided is accurate and lawful.
• The entity complies with all applicable registration, licensing, and regulatory requirements.
• They accept these Terms on behalf of the entity.

5.4 Geographic Availability

Siliguri Circle is primarily designed to serve the city of Siliguri and surrounding regions. However, individuals, businesses, organizations, visitors, and members from other locations may access the Platform where such access is not prohibited by law.

Users accessing the Platform from outside India are solely responsible for ensuring that their use complies with all laws applicable in their jurisdiction.

5.5 Restricted Persons

You are not eligible to use the Platform if:

• You have previously been permanently suspended or banned by Siliguri Circle.
• You are impersonating another individual or organization.
• You have provided false, misleading, or fraudulent information.
• Your use of the Platform would violate any court order, governmental directive, or applicable law.
• You are using the Platform on behalf of an entity engaged in unlawful activities.
• You have been restricted from entering legally binding agreements under applicable law.

Siliguri Circle reserves the right to refuse registration, deny access, suspend services, or terminate accounts if a User is found to be ineligible.

5.6 Accuracy of Information

Eligibility to use the Platform depends upon the continued accuracy of the information provided by the User.

Users agree to maintain current and accurate information relating to their:

• Name and identity.
• Contact details.
• Business information.
• Professional qualifications (where applicable).
• Organization details.
• Licenses or registrations, where legally required.

Failure to maintain accurate information may result in restricted access, suspension, or termination of services.

5.7 No Automatic Right of Membership

Meeting the eligibility requirements does not guarantee acceptance as a member or approval of any account, listing, profile, advertisement, or service request.

Siliguri Circle reserves the sole and absolute discretion to approve, reject, suspend, or revoke any registration or membership application without creating any obligation to provide detailed reasons, except where required by applicable law.

5.8 Verification of Eligibility

Siliguri Circle may, at any time and without prior notice, verify a User's eligibility by requesting additional documentation or information, including but not limited to:

• Government-issued identification.
• Business registration certificates.
• Professional licenses.
• Proof of address.
• Organization authorization letters.
• Other documents reasonably necessary to verify eligibility.

Failure to provide requested documentation within a reasonable period may result in temporary suspension or permanent termination of the relevant account or services.

5.9 Ongoing Compliance

Eligibility is a continuing obligation. Users must remain compliant with these Terms throughout their use of the Platform. If, at any time, a User ceases to meet the eligibility requirements, they must immediately notify Siliguri Circle and discontinue any use of the affected services until the matter has been resolved.

Part 6 – User Accounts

Certain features and services offered by Siliguri Circle require the creation of a registered user account ("Account"). By creating, accessing, or using an Account, you agree to comply with these Terms and all applicable Platform Policies.

Your Account serves as your digital identity within the Platform and may provide access to community networking, citizen profiles, business listings, event participation, messaging, future premium memberships, marketplace services, and other features introduced by Siliguri Circle.

6.1 Account Registration

To access certain services, you may be required to complete the registration process by providing accurate, current, and complete information.

You agree that all registration information shall:

• Be truthful and not misleading.
• Belong to you or be submitted with proper authorization.
• Be maintained and updated whenever changes occur.
• Not infringe upon the rights of any third party.
• Comply with all applicable laws and these Terms.

Siliguri Circle reserves the right to reject any registration request that appears incomplete, inaccurate, misleading, fraudulent, offensive, or otherwise inconsistent with the objectives of the Platform.

6.2 One Account Per Individual

Unless expressly authorized in writing by Siliguri Circle, each individual may maintain only one personal Account on the Platform.

Businesses, organizations, institutions, or other legal entities may create separate Business Profiles or Organization Profiles where permitted.

Creating duplicate accounts to circumvent restrictions, manipulate rankings, mislead Users, or abuse Platform functionality is strictly prohibited.

6.3 Account Credentials

You are solely responsible for maintaining the confidentiality of your login credentials, including your username, email address, password, one-time passwords (OTPs), authentication codes, and any other security credentials associated with your Account.

You agree to:

• Create a strong and unique password.
• Keep your credentials confidential.
• Not share your Account with any other person.
• Log out after using shared or public devices.
• Promptly notify Siliguri Circle of any suspected unauthorized access.

Siliguri Circle shall not be liable for any loss or damage arising from your failure to safeguard your Account credentials.

6.4 Responsibility for Account Activity

You are fully responsible for all activities carried out through your Account, regardless of whether such activities were authorized by you.

This includes, but is not limited to:

• Profile updates.
• Business listings.
• Messages and communications.
• Reviews and ratings.
• Event registrations.
• Marketplace activities.
• Advertising submissions.
• Content uploads.
• Payments and purchases.

6.5 Account Security

Siliguri Circle employs reasonable administrative, technical, and organizational measures to protect user accounts. However, no internet-based service can guarantee absolute security.

Users acknowledge that the transmission of information over the internet carries inherent risks and agree that they use the Platform at their own risk.

6.6 Unauthorized Access

If you become aware of any unauthorized access, suspected compromise, identity theft, or misuse of your Account, you must immediately:

1. Change your password.
2. Secure any associated email accounts.
3. Notify Siliguri Circle without undue delay.
4. Cooperate with any reasonable investigation.

Siliguri Circle may temporarily suspend access to an Account while investigating suspected security incidents.

6.7 Accurate Account Information

Users must ensure that all information associated with their Account remains accurate, complete, and up to date.

This includes, where applicable:

• Full legal name.
• Email address.
• Mobile number.
• Residential or business address.
• Profile photograph.
• Professional details.
• Business information.
• Emergency or alternate contact information.

Siliguri Circle reserves the right to request updated information whenever reasonably necessary.

6.8 Account Ownership

Accounts are personal to the registered User and may not be sold, transferred, assigned, licensed, leased, inherited, or otherwise conveyed to another person or entity without the prior written consent of Siliguri Circle.

Any attempted transfer of an Account without authorization shall be deemed null and void.

6.9 Right to Refuse or Restrict Accounts

Siliguri Circle reserves the right, at its sole discretion and without prejudice to any other rights available under law, to refuse registration, limit functionality, impose verification requirements, suspend access, or permanently deactivate any Account where it reasonably believes such action is necessary to:

• Protect the Platform and its Users.
• Prevent fraud or abuse.
• Maintain community integrity.
• Comply with legal obligations.
• Investigate suspected violations of these Terms.
• Protect the rights or reputation of Siliguri Circle.

6.10 Survival of Obligations

Closure, suspension, or termination of an Account shall not affect any rights, obligations, liabilities, indemnities, licenses, or legal remedies that accrued prior to such closure, suspension, or termination. Siliguri Circle may retain certain Account records where required by law, regulatory obligations, fraud prevention measures, dispute resolution, or legitimate business purposes in accordance with its Privacy Policy.

Part 7 – Account Registration

To access certain features and services available through Siliguri Circle, Users may be required to register for an account. Registration enables access to community networking, citizen and business profiles, directory listings, event participation, messaging, future premium memberships, marketplace features, and other services that may be introduced from time to time.

By registering an account, you represent and warrant that all information submitted during the registration process is true, accurate, complete, and current. You further agree to maintain and promptly update such information whenever necessary.

7.1 Registration Requirements

During registration, you may be required to provide certain information, including but not limited to:

• Full legal name.
• Email address.
• Mobile phone number.
• Date of birth (where applicable).
• Residential or business address.
• Profile photograph.
• Password or authentication credentials.
• Business information (for business accounts).
• Organization details (where applicable).
• Any additional information reasonably requested by Siliguri Circle.

Certain services may require additional information before access is granted.

7.2 Accuracy of Registration Information

You agree that all information submitted during registration shall:

• Be truthful and not misleading.
• Belong to you or be submitted with proper authorization.
• Not contain impersonated identities.
• Not violate the rights of any third party.
• Comply with all applicable laws.

Submission of false, misleading, incomplete, or fraudulent information may result in rejection of your registration, suspension of your account, or permanent termination of access to the Platform.

7.3 Unique User Identity

Every registered account should represent a genuine individual, business, organization, or institution. Users shall not create accounts using:

• False names.
• Fictitious identities.
• Another person's identity.
• Stolen information.
• Temporary or disposable identities intended to avoid accountability.

Siliguri Circle reserves the right to request supporting documentation to verify account ownership at any time.

7.4 Username and Profile Name

Users may be permitted to select a username, display name, or profile name for use on the Platform.

Usernames and profile names must not:

• Impersonate another individual or organization.
• Contain offensive, abusive, defamatory, obscene, or discriminatory language.
• Infringe trademarks or intellectual property rights.
• Promote illegal activities.
• Mislead other Users regarding identity or affiliation.

Siliguri Circle reserves the right to modify, reject, or require the replacement of any username or display name that violates these Terms or is otherwise deemed inappropriate.

7.5 Registration Approval

Submission of a registration request does not automatically create a binding membership relationship or guarantee approval.

Siliguri Circle reserves the right to:

• Approve or reject any registration.
• Request additional documentation.
• Conduct verification procedures.
• Delay activation pending review.
• Reject applications that do not meet Platform requirements.

7.6 Business and Organization Registration

Business entities, educational institutions, government bodies, non-governmental organizations, clubs, associations, and other legal entities may register only through an individual who has proper authority to represent that entity.

The registering representative warrants that they possess all necessary permissions to bind the entity to these Terms and to manage its profile on the Platform.

7.7 Communication During Registration

During the registration process, Siliguri Circle may send communications by email, SMS, telephone, in-platform notifications, or other electronic means for purposes including:

• Identity verification.
• One-time passwords (OTPs).
• Registration confirmation.
• Security alerts.
• Account activation.
• Important service notifications.

Users acknowledge that receipt of such communications is necessary for the operation and security of the Platform.

7.8 Ongoing Registration Obligations

Registration is an ongoing commitment rather than a one-time process. Registered Users agree to:

• Keep their account information accurate and current.
• Promptly update changes to contact details or business information.
• Cooperate with verification requests.
• Maintain the security of their account credentials.
• Comply with all applicable Platform Policies.

7.9 Refusal or Cancellation of Registration

Siliguri Circle reserves the absolute right, at its sole discretion and without creating any obligation to provide detailed reasons, to refuse, cancel, suspend, or revoke any registration where it reasonably believes that:

• The applicant has provided false or misleading information.
• The registration violates these Terms.
• The applicant poses a security, legal, or reputational risk.
• The registration is fraudulent or abusive.
• The applicant has previously violated Platform policies.
• Such action is necessary to protect the Platform or its community.

Any such decision shall be without prejudice to any other rights or remedies available to Siliguri Circle under applicable law.

Part 8 – Identity Verification

To maintain a trusted, secure, and authentic community, Siliguri Circle reserves the right to verify the identity of Users, Businesses, Organizations, Event Organizers, Advertisers, Sponsors, Marketplace Sellers, Premium Members, and any other individual or entity using the Platform.

Identity verification helps reduce fraud, impersonation, spam, fake accounts, and other forms of misuse while promoting a safer experience for all members of the community.

8.1 Right to Verify Identity

Siliguri Circle may, at any time and at its sole discretion, request additional information or documentation to verify the identity, legitimacy, ownership, or authority of any User or Account.

Verification may be required during account registration, profile updates, business verification, premium membership applications, event creation, advertising campaigns, marketplace participation, or whenever suspicious activity is detected.

8.2 Verification Information

Depending on the nature of the account or service requested, Users may be required to provide one or more of the following:

• Government-issued photo identification.
• PAN Card.
• Aadhaar Card (where voluntarily provided and permitted by applicable law).
• Passport.
• Driving Licence.
• Voter Identity Card.
• Business Registration Certificate.
• GST Registration Certificate.
• Trade Licence.
• Certificate of Incorporation.
• Professional licence or certification.
• Proof of residential or business address.
• Authorization letter for organizations.
• Selfie or live verification photograph.
• Any other documentation reasonably necessary to verify identity.

The specific documents requested may vary depending upon the services being used and the level of verification required.

8.3 Business Verification

Businesses, startups, shops, restaurants, educational institutions, non-governmental organizations, government bodies, and other legal entities may be required to complete an enhanced verification process before certain features become available.

Verification may include confirmation of:

• Legal existence of the business or organization.
• Ownership or management authority.
• Business registration status.
• Licences and regulatory approvals.
• Business address.
• Official contact details.
• Tax registrations where applicable.

8.4 Verification Does Not Constitute Endorsement

Completion of any verification process or the display of a verification badge, status, or indicator does not constitute a recommendation, certification, guarantee, warranty, endorsement, accreditation, or approval by Siliguri Circle regarding the User, Business, Organization, products, services, financial condition, reputation, or reliability.

Users remain responsible for exercising their own judgment before entering into any transaction or relationship with another User.

8.5 Ongoing Verification

Verification is not a one-time process. Siliguri Circle may periodically request updated documentation or additional information to ensure that verification records remain current, accurate, and complete.

Users agree to cooperate with reasonable verification requests within the time specified by Siliguri Circle.

8.6 Failure to Complete Verification

Failure or refusal to complete requested verification procedures may result in one or more of the following actions:

• Restriction of certain Platform features.
• Temporary suspension of the Account.
• Removal of listings or published content.
• Rejection of Business Profiles.
• Cancellation of event listings.
• Denial of Premium Membership.
• Marketplace restrictions.
• Permanent termination of the Account in serious cases.

8.7 False Verification Information

Users shall not submit forged, altered, misleading, stolen, expired, fraudulent, or otherwise invalid identification documents or verification materials.

Submission of false verification information constitutes a material breach of these Terms and may result in immediate suspension or permanent termination of the Account, removal of content, reporting to appropriate authorities where required by law, and any other legal remedies available to Siliguri Circle.

8.8 Privacy of Verification Information

Verification documents and related personal information shall be collected, processed, stored, and protected in accordance with the applicable laws of India and the Siliguri Circle Privacy Policy.

Siliguri Circle will implement reasonable administrative, technical, and organizational safeguards to protect verification information from unauthorized access, disclosure, alteration, or misuse. However, no method of electronic transmission or storage can be guaranteed to be completely secure.

8.9 Fraud Prevention Measures

Siliguri Circle may use manual reviews, automated systems, third-party verification services, fraud detection tools, risk assessments, and other lawful methods to detect suspicious activity, prevent identity theft, and maintain the integrity of the Platform.

Users acknowledge and agree that such measures are necessary for the safety, security, and reliability of the Platform and its community.

8.10 Reservation of Rights

Siliguri Circle reserves the right to approve, reject, suspend, revoke, or require re-verification of any account or profile at any time where it reasonably believes that doing so is necessary to protect Users, comply with applicable law, investigate suspected misconduct, or preserve the integrity, reputation, and security of the Platform.

Part 9 – Membership Rules

Membership in Siliguri Circle is intended to create a safe, trustworthy, inclusive, and collaborative community where citizens, professionals, entrepreneurs, businesses, organizations, educational institutions, and visitors can connect, communicate, and contribute responsibly.

By becoming a Member of the Platform, you agree to comply with these Membership Rules, all Platform Policies, applicable laws of India, and any additional guidelines issued by Siliguri Circle from time to time.

9.1 Membership Categories

Siliguri Circle may offer one or more categories of membership, including but not limited to:

• Citizen Membership
• Business Membership
• Professional Membership
• Organization Membership

• Respect cultural, social, and religious diversity.
• Contribute positively to the community.
• Comply with all applicable laws and regulations.

9.4 Member Responsibilities

Each Member is responsible for ensuring that their use of the Platform:

• Does not violate these Terms.
• Does not infringe the rights of others.
• Does not interfere with the operation of the Platform.
• Does not damage the reputation of Siliguri Circle.
• Does not expose other Users to fraud or harm.

Members remain solely responsible for all actions performed through their accounts and for all content they publish on the Platform.

9.5 Membership Benefits

Membership may provide access to various features and services, including, where available:

• Citizen networking.
• Business networking.
• Professional connections.
• Directory listings.
• Event participation.
• Community forums.
• Messaging features.
• Business promotion.
• Premium services.
• Marketplace participation.
• Future Platform enhancements.

Availability of specific benefits may vary depending on membership type and may change without prior notice.

9.6 Membership Restrictions

Members shall not:

• Transfer or sell their membership.
• Share account access with unauthorized persons.
• Create multiple accounts to bypass restrictions.
• Misrepresent their identity or affiliations.
• Use membership for unlawful or fraudulent purposes.
• Exploit Platform features in a manner that disrupts other Users.

9.7 Membership Renewal and Future Subscription Plans

If Siliguri Circle introduces subscription-based or premium memberships in the future, such memberships may be subject to separate pricing, renewal terms, billing cycles, and additional conditions.

Continued use of premium services after renewal shall constitute acceptance of the applicable subscription terms then in effect.

9.8 Compliance Monitoring

Siliguri Circle may monitor membership activity, profile information, communications, listings, and other interactions to ensure compliance with these Terms, protect community safety, investigate suspected violations, and improve Platform services.

Such monitoring shall be carried out in accordance with applicable law and the Platform's Privacy Policy.

9.9 Suspension or Revocation of Membership

Membership may be suspended, restricted, or permanently revoked if a Member:

• Violates these Terms or any Platform Policy.
• Provides false or misleading information.
• Engages in harassment, abuse, or unlawful conduct.
• Publishes prohibited or harmful content.
• Attempts to compromise Platform security.
• Engages in fraudulent or deceptive practices.
• Acts in a manner likely to damage the reputation or integrity of Siliguri Circle.

Siliguri Circle may take such action immediately where reasonably necessary to protect the Platform, its Users, or comply with legal obligations.

9.10 No Guarantee of Continued Membership

Membership does not create any ownership interest, employment relationship, partnership, agency, franchise, or contractual entitlement to continued access. Siliguri Circle reserves the right to modify, suspend, or discontinue membership programs or related services at any time, subject to applicable law.

9.11 Cooperation with Platform Administration

Members agree to cooperate with reasonable requests made by Siliguri Circle relating to account verification, investigations, dispute resolution, moderation activities, security reviews, or compliance matters. Failure to cooperate may result in temporary restrictions or other appropriate action under these Terms.

Part 10 – Community Guidelines

Siliguri Circle is built to encourage meaningful connections among citizens, businesses, professionals, organizations, and visitors. Every User contributes to the quality, safety, and integrity of the community. These Community Guidelines establish the standards of conduct expected from every person using the Platform.

By accessing or using the Platform, you agree to interact responsibly, respectfully, and lawfully. Failure to comply with these Community Guidelines may result in warnings, content removal, temporary suspension, permanent account termination, or other actions as described in these Terms and Conditions.

10.1 Respectful Conduct

Every User is expected to communicate with courtesy, honesty, and professionalism.

Users shall:

• Treat every member with dignity and respect.
• Encourage constructive conversations.
• Respect differences in opinion.
• Promote collaboration and community engagement.
• Support a welcoming and inclusive environment.

10.2 Prohibited Behaviour

Users shall not engage in conduct that harms other Users or the Platform, including but not limited to:

• Hate speech or discrimination.
• Defamation or malicious allegations.
• Obscene, vulgar, or offensive language.
• Stalking or unwanted contact.
• Incitement to violence or unlawful activity.
• Personal attacks or abusive behaviour.

10.3 Authentic Participation

Members are expected to participate honestly and transparently.

Users shall not:

• Impersonate another person or organization.
• Create fake identities.
• Operate multiple deceptive accounts.
• Misrepresent qualifications or affiliations.
• Use another person's photographs or identity without permission.

10.4 Lawful Use

All activity conducted on the Platform must comply with applicable laws, regulations, and governmental requirements.

Users shall not use the Platform to promote, organize, facilitate, or participate in illegal activities of any kind.

10.5 Community Discussions

Community discussions should remain relevant, respectful, and constructive. Members are encouraged to:

Discussions intended solely to provoke conflict, spread misinformation, or intentionally disrupt the community may be removed.

10.7 Business Conduct

Business Users shall:

• Honour legitimate commitments made to customers.

10.8 Events and Community Activities

Organizers publishing events through Siliguri Circle are responsible for ensuring that event information is accurate, lawful, and up to date.

Event organizers must conduct activities in a safe and responsible manner and comply with all applicable permissions, licences, and legal requirements.

10.9 Reporting Violations

Users are encouraged to report content or behaviour that they reasonably believe violates these Terms or Community Guidelines.

Reports should be made honestly and in good faith. Knowingly submitting false, malicious, or abusive reports may itself constitute a violation of these Terms.

10.10 Cooperation with Moderation

Users agree to cooperate with reasonable moderation requests, including requests for clarification, verification, correction of information, or removal of content that may violate these Terms.

Failure to cooperate may result in temporary restrictions or other enforcement actions.

10.11 Community Safety

Siliguri Circle may take immediate action where reasonably necessary to protect the safety, security, reputation, or integrity of the Platform or its Users. Such action may include content removal, temporary account restrictions, suspension, or permanent termination in accordance with these Terms.

10.12 Community Values

Siliguri Circle is founded on the principles of trust, integrity, collaboration, inclusion, civic responsibility, and mutual respect. Every User is encouraged to contribute positively toward building a stronger, more connected community for the people of Siliguri and beyond.

Part 11 – Citizen Profiles

Citizen Profiles enable individuals to participate in the Siliguri Circle community by creating a personal presence on the Platform. A Citizen Profile may be used to network with other members, discover local opportunities, participate in community discussions, register for events, follow businesses and organizations, and access additional Platform services.

By creating or maintaining a Citizen Profile, you agree to comply with these Terms and all applicable Platform Policies.

11.1 Profile Eligibility

A Citizen Profile may only be created by an individual who satisfies the eligibility requirements set out in these Terms. The profile must represent the actual person creating or using the account.

Users shall not create Citizen Profiles on behalf of another individual without that person's express authorization or other lawful authority.

11.2 Profile Information

Users may provide personal and professional information within their Citizen Profile, including but not limited to:

• Full name.
• Profile photograph.
• Biography or introduction.
• Occupation or profession.
• Educational background.
• Skills and expertise.
• Areas of interest.
• Social media links.
• Website or portfolio links.
• Community interests.
• Other information voluntarily submitted by the User.

Users remain solely responsible for ensuring that all profile information is accurate, current, and lawful.

11.3 Accuracy of Profile Information

Users agree not to publish false, misleading, deceptive, incomplete, or fraudulent information within their Citizen Profile.

Siliguri Circle reserves the right to request clarification, correction, or verification of any profile information where reasonably necessary.

11.4 Profile Photographs

Users may upload profile photographs provided that they:

• Accurately represent the User.
• Do not infringe any copyright or other intellectual property rights.
• Do not contain offensive, obscene, or unlawful material.
• Do not impersonate another individual.
• Comply with all applicable Platform Policies.

Siliguri Circle may remove or replace profile images that violate these Terms without prior notice.

11.5 Professional Representation

Users who identify themselves as professionals, consultants, freelancers, educators, healthcare providers, legal professionals, or members of any regulated profession must ensure that all qualifications, certifications, licences, memberships, and professional claims are truthful and supported where required by law.

Siliguri Circle does not independently verify professional qualifications unless expressly stated.

11.6 Privacy Controls

Where available, Users may manage certain visibility and privacy settings relating to their Citizen Profile. Such settings may allow Users to control the visibility of selected information to other members or the general public.

Users acknowledge that information intentionally made public may be viewed, shared, or indexed by third parties, subject to applicable law.

11.7 Profile Content

All text, photographs, videos, links, documents, achievements, comments, and other materials published within a Citizen Profile constitute User-Generated Content and remain subject to these Terms.

Users warrant that they possess all necessary rights, permissions, and licences to publish such content.

11.8 Prohibited Profile Content

Citizen Profiles shall not contain content that:

• Violates applicable law.
• Is fraudulent or misleading.
• Infringes intellectual property rights.
• Contains hate speech or discriminatory material.
• Includes malware or malicious code.
• Promotes unlawful products or services.
• Contains explicit or obscene material.
• Violates the privacy or rights of others.

11.9 Profile Verification

Siliguri Circle may, but is not obligated to, verify the identity or authenticity of a Citizen Profile. Verification badges, indicators, or statuses, where provided, signify only that certain verification procedures have been completed and do not constitute an endorsement, recommendation, or guarantee of the User.

11.10 Modification and Removal

Users may update their Citizen Profiles at any time, subject to these Terms. Siliguri Circle reserves the right to edit, restrict, temporarily disable, or permanently remove profile information where reasonably necessary to:

• Enforce these Terms.
• Protect the safety of Users.
• Comply with legal obligations.
• Investigate suspected misconduct.
• Maintain the integrity and reputation of the Platform.

11.11 No Guarantee of Visibility

The creation of a Citizen Profile does not guarantee visibility in search results, directory listings, recommendations, networking suggestions, or promotional placements. Siliguri Circle may determine the display, ranking, organization, or presentation of profiles using automated systems, editorial decisions, relevance factors, or other lawful criteria.

11.12 User Responsibility

Each User remains solely responsible for the content, accuracy, legality, and consequences of maintaining a Citizen Profile. Siliguri Circle assumes no responsibility for interactions, communications, agreements, or transactions that may arise between Users through Citizen Profiles unless expressly stated otherwise.

Part 12 – Business Profiles

Business Profiles allow businesses, startups, retailers, service providers, professionals, educational institutions, non-governmental organizations, associations, and other legal entities to establish an official presence on Siliguri Circle. Business Profiles are intended to help users discover local products, services, organizations, and opportunities while fostering trusted connections within the community.

By creating, claiming, managing, or maintaining a Business Profile, you agree to comply with these Terms and all applicable Platform Policies.

12.1 Eligibility to Create a Business Profile

A Business Profile may only be created by:

• The legal owner of the business.
• A partner or director of the business.
• An authorized employee.
• An appointed marketing or administrative representative.
• A person otherwise authorized to act on behalf of the business or organization.

The person creating or managing the profile represents and warrants that they possess the authority to bind the business or organization to these Terms.

12.2 Business Information

Business Profiles may include, where applicable:

• Business or organization name.
• Business logo.
• Business description.
• Category and industry.
• Products and services.
• Business address.
• Operating hours.
• Contact information.
• Email address.
• Website URL.
• Social media links.
• Images and videos.
• Licences or certifications.
• GST or registration information where voluntarily provided.
• Other information approved by Siliguri Circle.

12.3 Accuracy of Business Information

Business owners and authorized representatives must ensure that all information published in their Business Profile is accurate, complete, current, and not misleading.

Businesses agree to promptly update their profiles whenever material information changes, including changes to contact details, address, ownership, operating hours, services, or business status.

12.4 Lawful Business Operations

Businesses using the Platform represent and warrant that they conduct their operations in compliance with all applicable laws, regulations, licences, permits, and governmental requirements.

Siliguri Circle may request reasonable documentation to verify the legal status or authority of any business listed on the Platform.

12.5 Business Verification

Siliguri Circle may offer optional or mandatory business verification for selected categories of businesses or services.

Verification may involve reviewing documents such as:

• Certificate of Incorporation.
• Trade Licence.
• GST Registration Certificate.
• Business Registration Certificate.
• Professional licences.
• Proof of business address.
• Authorization letters.
• Other documents reasonably required for verification.

Verification indicates only that certain information has been reviewed. It does not constitute a certification, endorsement, recommendation, or guarantee of the business, its products, or its services.

12.6 Business Content

Businesses may publish descriptions, photographs, logos, promotional material, announcements, catalogues, menus, service details, pricing information, videos, and other content relevant to their operations, provided such content:

• Is lawful and truthful.
• Does not infringe intellectual property rights.
• Does not contain false or deceptive advertising.
• Complies with applicable advertising laws.
• Does not violate these Terms.

12.7 Business Responsibilities

Businesses are solely responsible for:

• The accuracy of their published information.
• Products and services they offer.
• Customer communications.
• Business transactions.
• Pricing and promotional offers.
• Compliance with consumer protection laws.
• Obtaining any required licences or approvals.

Siliguri Circle is not a party to transactions between businesses and customers unless expressly stated otherwise.

12.8 Prohibited Business Activities

Businesses shall not use the Platform to:

• Offer unlawful products or services.
• Promote counterfeit or infringing goods.
• Publish deceptive advertisements.
• Engage in fraudulent or misleading practices.
• Manipulate reviews or ratings.
• Impersonate another business.
• Misrepresent qualifications, licences, or certifications.
• Engage in unfair competition or abusive commercial practices.

12.9 Business Rankings and Visibility

Siliguri Circle may determine the order, prominence, or visibility of Business Profiles using automated systems, editorial decisions, relevance, geographic location, user preferences, engagement metrics, verification status, premium services, or other lawful factors.

No business is guaranteed any specific ranking, visibility, search position, recommendation, or promotional placement unless expressly provided under a separate written agreement.

12.10 Profile Suspension or Removal

Siliguri Circle reserves the right to suspend, restrict, edit, or remove a Business Profile where it reasonably believes that:

• The profile violates these Terms.
• Information is false or misleading.
• The business engages in unlawful conduct.
• Fraudulent activity is suspected.
• The profile infringes the rights of others.
• Removal is necessary to comply with legal obligations.
• Removal is required to protect the Platform or its Users.

12.11 No Endorsement

The presence of a Business Profile on Siliguri Circle, whether verified, featured, sponsored, or otherwise displayed, does not constitute an endorsement, recommendation, guarantee, partnership, agency relationship, certification, or warranty by Siliguri Circle regarding the business, organization, products, services, pricing, quality, reliability, or suitability for any particular purpose.

Users are solely responsible for conducting their own due diligence before engaging with any business listed on the Platform.

Part 13 – Directory Listings

Siliguri Circle provides searchable directory services to help users discover citizens, businesses, professionals, organizations, educational institutions, public services, events, community groups, and other relevant listings within and around Siliguri. The Directory is intended solely as an informational and networking resource and should not be interpreted as an endorsement or recommendation by Siliguri Circle.

13.1 Purpose of the Directory

The Directory is designed to facilitate meaningful connections between members of the community by making publicly available information easier to discover and access.

Listings may include individuals, businesses, organizations, institutions, community initiatives, events, products, services, or other categories introduced by Siliguri Circle from time to time.

13.2 Eligibility for Directory Listings

Directory Listings may be created by:

• Registered Users.
• Verified Businesses.
• Authorized representatives of organizations or institutions.
• Approved community partners.
• Administrators of Siliguri Circle.

Siliguri Circle reserves the right to determine whether a listing is eligible for inclusion in the Directory.

13.3 Listing Information

Directory Listings may contain, where applicable:

• Name of the individual or entity.
• Business or organization logo.
• Description.
• Category or industry.
• Address or service area.
• Contact information.
• Email address.
• Website and social media links.
• Operating hours.
• Photographs or videos.
• Products or services.
• User reviews and ratings.

13.4 Accuracy of Listings

The person or entity responsible for a Directory Listing is solely responsible for ensuring that all published information is accurate, complete, current, and lawful.

Users must promptly update their listing whenever material information changes.

Siliguri Circle does not guarantee the completeness, accuracy, reliability, or availability of any Directory Listing.

13.5 Verification of Listings

Siliguri Circle may verify selected Directory Listings through manual review, documentation, third-party verification, or other reasonable verification procedures.

Verification does not constitute legal certification, endorsement, recommendation, accreditation, or a guarantee of quality, reliability, or suitability.

13.6 Search Results and Ranking

Directory Listings may appear in search results, recommendations, featured sections, category pages, or other areas of the Platform based on factors including, but not limited to:

• Relevance to the user's search.
• Location or geographic proximity.
• Profile completeness.
• Verification status.
• Category selection.
• User engagement.
• Content quality.
• Premium promotional services.
• Editorial or automated ranking systems.

Siliguri Circle does not guarantee that any listing will appear in a particular position or receive a specific level of visibility.

13.7 Prohibited Listings

Directory Listings must not:

• Contain false or misleading information.
• Promote unlawful products or services.
• Infringe intellectual property rights.
• Impersonate another individual or entity.
• Contain malware or harmful code.
• Include offensive, obscene, or defamatory material.
• Mislead users regarding business status or qualifications.
• Violate these Terms or applicable law.

13.8 Editing and Moderation

Siliguri Circle reserves the right, but not the obligation, to review, edit, categorize, reformat, update, suspend, or remove any Directory Listing where it reasonably believes such action is necessary to:

• Maintain directory quality.
• Correct formatting or categorization.
• Investigate suspected violations.
• Comply with legal obligations.
• Protect Users or the Platform.

13.9 Removal of Listings

Siliguri Circle may remove a Directory Listing without prior notice if:

• The listing violates these Terms.
• The information is fraudulent or misleading.
• The listing has become obsolete or inactive.
• Required verification is not completed.
• A competent legal authority requires removal.
• Removal is reasonably necessary to protect the Platform or its Users.

13.10 Third-Party Reliance

Users acknowledge that any reliance upon information contained in a Directory Listing is entirely at their own risk. Before entering into any commercial, professional, or personal relationship with a listed individual or entity, Users should undertake their own independent verification and due diligence.

13.11 No Endorsement

The inclusion, display, ranking, verification, sponsorship, or promotion of any Directory Listing does not constitute an endorsement, recommendation, guarantee, certification, partnership, or warranty by Siliguri Circle regarding the listed person, business, organization, institution, product, or service.

13.12 Reservation of Rights

Siliguri Circle reserves the right to introduce new directory categories, modify listing requirements, implement verification procedures, revise ranking methodologies, or discontinue any portion of the Directory at any time, with or without prior notice, subject to applicable law.

Part 14 – Event Listings

Siliguri Circle provides a platform for promoting, discovering, organizing, and participating in events that contribute to the social, cultural, educational, professional, business, and community life of Siliguri and surrounding regions. Event Listings enable individuals, businesses, organizations, institutions, and community groups to publish information about upcoming activities and connect with interested participants.

Unless expressly stated otherwise, Siliguri Circle acts solely as a digital platform for publishing and discovering event information and is not the organizer, promoter, sponsor, or operator of third-party events.

14.1 Eligibility to Publish Events

Event Listings may be created by:

• Registered Users.
• Verified Businesses.
• Educational institutions.
• Government agencies.
• Registered non-governmental organizations.
• Community groups and associations.
• Authorized event organizers.
• Other entities approved by Siliguri Circle.

The person publishing an Event Listing represents that they have the legal authority to organize, manage, or promote the event.

14.2 Event Information

Event organizers are responsible for ensuring that all information submitted is accurate, complete, and current. Event Listings may include:

• Event title.
• Description.
• Date and time.
• Venue or online meeting details.
• Organizer information.
• Registration requirements.
• Participation fees, if any.
• Photographs or promotional banners.
• Contact details.
• Terms of participation.
• Any other relevant information approved by Siliguri Circle.

14.3 Organizer Responsibilities

Event organizers are solely responsible for the planning, management, and execution of their events.

Organizers agree to:

• Provide truthful and accurate event information.
• Obtain all necessary licences and permissions.
• Comply with applicable laws and local regulations.
• Maintain appropriate health and safety standards.
• Promptly communicate any changes or cancellations.
• Conduct events in a professional and lawful manner.

14.4 Event Modifications and Cancellations

Event organizers may modify or cancel their events at any time, subject to applicable laws and any commitments made to participants.

Organizers should promptly update the Event Listing to reflect changes to dates, venues, schedules, registration requirements, or cancellation notices.

Siliguri Circle is not responsible for losses or inconvenience resulting from event changes, postponements, or cancellations made by organizers.

14.5 Event Registration

The Platform may permit Users to express interest in or register for events. Registration through the Platform does not guarantee admission unless expressly confirmed by the event organizer.

Organizers remain solely responsible for participant selection, capacity limits, attendance policies, ticket issuance, and entry management.

14.6 Paid Events

Where an event requires payment, the organizer is responsible for clearly disclosing all applicable fees, taxes, refund policies, eligibility requirements, and participation conditions.

Unless Siliguri Circle expressly acts as the payment facilitator under a separate agreement, all financial transactions occur directly between the organizer and participants.

14.7 Prohibited Events

Users shall not publish or promote events that:

• Violate applicable law.
• Promote violence, terrorism, or criminal activity.
• Encourage discrimination or hate speech.
• Infringe intellectual property rights.
• Contain misleading or fraudulent information.
• Promote prohibited goods or services.
• Endanger public safety or public health.
• Otherwise violate these Terms or Platform Policies.

14.8 Event Moderation

Siliguri Circle reserves the right, but not the obligation, to review, verify, edit, categorize, feature, suspend, or remove Event Listings where reasonably necessary to:

• Maintain Platform quality.
• Protect Users.
• Investigate complaints.
• Prevent fraud or abuse.
• Comply with applicable laws.
• Enforce these Terms.

14.9 Participant Responsibility

Users choosing to attend or participate in an event do so voluntarily and at their own risk. Participants are responsible for evaluating the suitability, safety, legality, and reliability of an event before attending.

Participants should exercise reasonable judgment and comply with the organizer's lawful instructions and venue requirements.

14.10 Limitation of Responsibility

Unless expressly stated otherwise, Siliguri Circle is not responsible for:

• The organization or operation of third-party events.
• Event cancellations or postponements.
• Venue conditions.
• Participant conduct.
• Ticketing disputes.
• Refunds issued by organizers.
• Personal injury or property damage arising from attendance.
• Any agreement between organizers and participants.

14.11 No Endorsement

The publication, verification, promotion, sponsorship, recommendation, or featuring of an Event Listing on Siliguri Circle does not constitute an endorsement, certification, guarantee, or warranty regarding the event, its organizer, venue, speakers, sponsors, safety, quality, legality, or suitability.

14.12 Reservation of Rights

Siliguri Circle reserves the right to establish additional event requirements, verification procedures, moderation standards, promotional criteria, participation rules, and technical limitations for Event Listings at any time, subject to applicable law and these Terms.

Part 15 – Marketplace Rules (Future Marketplace Services)

This section shall apply if Siliguri Circle introduces a digital Marketplace through which Users may advertise, buy, sell, rent, exchange, book, reserve, promote, or otherwise transact in relation to products, services, digital goods, event tickets, memberships, or other offerings ("Marketplace").

Until such Marketplace is officially launched, these provisions remain dormant but shall automatically become effective upon the introduction of any Marketplace functionality on the Platform.

15.1 Role of Siliguri Circle

Unless expressly stated otherwise in writing, Siliguri Circle acts solely as an intermediary technology platform that facilitates interactions between independent buyers and sellers.

Siliguri Circle is not:

• The owner of goods offered by third-party sellers.
• The manufacturer of any product.
• A retailer or reseller.
• An importer or exporter.
• An agent of buyers or sellers.
• A party to contracts formed between Marketplace users.

All contracts, negotiations, deliveries, warranties, payments, and disputes relating to Marketplace transactions shall exist solely between the relevant buyer and seller unless expressly agreed otherwise.

15.2 Eligibility to Sell

Marketplace listings may only be created by Users who:

• Maintain an active Platform account.
• Provide accurate identity information.
• Possess all necessary legal authority to sell the listed products or services.
• Comply with all applicable laws and regulations.
• Meet any verification requirements established by Siliguri Circle.

Siliguri Circle reserves the right to require additional documentation before permitting Marketplace participation.

15.3 Product and Service Listings

Sellers are solely responsible for ensuring that every Marketplace Listing:

• Accurately describes the product or service.
• Includes truthful pricing.
• Contains current availability information.
• Uses authentic photographs where possible.
• Does not contain misleading claims.
• Complies with applicable consumer protection laws.

Listings shall not omit material information that could influence a purchasing decision.

15.4 Prohibited Products and Services

The following may not be advertised, sold, offered, promoted, or otherwise made available through the Marketplace unless expressly permitted by applicable law and approved by Siliguri Circle:

• Illegal products or services.
• Counterfeit goods.
• Stolen property.
• Fraudulent investment schemes.
• Products infringing intellectual property rights.
• Explosives or hazardous materials.
• Illegal drugs or narcotics.
• Products requiring licences that the seller does not possess.
• Adult or obscene material prohibited by law.
• Any item prohibited by applicable Indian law.

Siliguri Circle may expand or modify the list of prohibited items at any time.

15.5 Pricing

Sellers are responsible for determining and displaying accurate pricing. Prices shall clearly indicate whether applicable taxes, delivery charges, service fees, or other charges are included or excluded.

Siliguri Circle reserves the right to remove listings containing clearly misleading, deceptive, or erroneous pricing.

15.6 Orders and Transactions

Buyers and sellers are solely responsible for completing transactions, including communication, payment, delivery, inspection, acceptance, and fulfilment.

Siliguri Circle does not guarantee:

• Completion of any transaction.
• Availability of listed products.
• Seller performance.
• Buyer performance.
• Delivery timelines.
• Product quality.
• Merchantability or fitness for a particular purpose.

15.7 Payments

Where payment processing is provided by third-party payment service providers, Users agree to comply with the terms and conditions of those providers.

Siliguri Circle may integrate payment gateways, escrow services, digital wallets, or other payment solutions in the future but does not guarantee uninterrupted availability of such services.

15.8 Delivery and Fulfilment

Sellers remain solely responsible for packaging, shipping, delivery, installation, after-sales service, warranty obligations, and customer support relating to their products or services unless expressly agreed otherwise.

15.9 Returns, Refunds, and Cancellations

Each seller shall clearly communicate their applicable return, replacement, cancellation, and refund policies before a transaction is completed.

Unless Siliguri Circle expressly states otherwise, disputes relating to refunds, replacements, defective goods, or order cancellations shall be resolved directly between the buyer and seller.

15.10 Fraud Prevention

Siliguri Circle may use automated systems, manual reviews, transaction monitoring, identity verification, and risk assessment tools to detect and prevent fraudulent Marketplace activity.

Suspicious transactions may be delayed, restricted, investigated, or cancelled where reasonably necessary to protect Users or comply with legal obligations.

15.11 Marketplace Suspension

Siliguri Circle reserves the right to suspend, restrict, or permanently remove any Marketplace Listing, Seller Account, Buyer Account, or Marketplace feature where it reasonably believes that such action is necessary to:

• Enforce these Terms.
• Prevent fraud or abuse.
• Protect consumers.
• Comply with applicable law.
• Protect the reputation or security of the Platform.

15.12 No Warranty or Endorsement

The availability, display, promotion, recommendation, verification, or advertisement of any Marketplace Listing does not constitute an endorsement, certification, guarantee, warranty, or representation by Siliguri Circle regarding the seller, buyer, product, service, price, quality, legality, safety, authenticity, availability, or suitability of any item offered through the Marketplace.

Part 16 – User-Generated Content

Siliguri Circle enables Users to create, upload, publish, submit, transmit, display, share, and otherwise make available various forms of content through the Platform. This content is collectively referred to as "User-Generated Content" or "UGC".

By submitting User-Generated Content to the Platform, you acknowledge and agree to the provisions of this section and represent that you possess all necessary rights and permissions relating to such content.

16.1 Types of User-Generated Content

User-Generated Content includes, but is not limited to:

• Citizen Profiles.
• Business Profiles.
• Directory Listings.
• Event Listings.
• Marketplace Listings.
• Comments and discussions.
• Reviews and ratings.
• Messages and replies.
• Photographs.
• Videos.
• Audio recordings.
• Documents and files.
• Logos and graphics.
• Articles, blogs, announcements, and other materials submitted by Users.

16.2 Ownership of Content

Except as expressly provided in these Terms, Users retain ownership of the intellectual property rights in the User-Generated Content they create and submit to the Platform.

Nothing in these Terms transfers ownership of User-Generated Content to Siliguri Circle.

16.3 Licence Granted to Siliguri Circle

By submitting, uploading, or publishing User-Generated Content, you grant Siliguri Circle a worldwide, non-exclusive, royalty-free, transferable, sublicensable, and perpetual licence (to the extent permitted by applicable law) to:

• Host and store the content.
• Display and publish the content.
• Copy and reproduce the content.
• Distribute the content.
• Format, resize, crop, and optimize the content.
• Translate or adapt the content for technical purposes.
• Index and organize the content.
• Promote the Platform using the content.
• Make the content available through Platform features and services.

This licence is granted solely for the purpose of operating, improving, promoting, securing, and providing the services offered by Siliguri Circle.

16.4 User Representations and Warranties

You represent and warrant that:

• You own or lawfully control the submitted content.
• You possess all necessary permissions and licences.
• The content does not infringe any copyright, trademark, patent, privacy, publicity, or other legal rights.
• The content complies with applicable laws.
• The content is accurate and not intentionally misleading.

16.5 Prohibited Content

Users shall not submit or publish content that:

• Violates applicable law.
• Contains defamatory statements.
• Includes hate speech or discriminatory material.
• Promotes violence or criminal activity.
• Contains malware or malicious code.
• Infringes intellectual property rights.
• Contains fraudulent or deceptive information.
• Violates another person's privacy.
• Contains obscene or sexually explicit material prohibited by law.
• Otherwise violates these Terms or Platform Policies.

16.6 Responsibility for Content

Users remain solely responsible for all User-Generated Content they submit, publish, or otherwise make available through the Platform.

Siliguri Circle does not routinely verify the accuracy, completeness, legality, or authenticity of User-Generated Content before publication.

16.7 Content Moderation

Siliguri Circle reserves the right, but not the obligation, to review, monitor, edit, restrict, hide, disable, or remove User-Generated Content where it reasonably believes such action is necessary to:

• Enforce these Terms.
• Protect Users or third parties.
• Comply with legal obligations.
• Respond to complaints.
• Prevent fraud or abuse.
• Maintain Platform quality and security.

16.8 Content Removal Requests

Siliguri Circle may remove or restrict User-Generated Content upon receipt of:

• A valid legal notice.
• A copyright complaint.
• A court order.
• A government directive.
• A violation report submitted through the Platform.
• Any other lawful request requiring review.

16.9 No Obligation to Publish

Submission of User-Generated Content does not obligate Siliguri Circle to publish, display, maintain, or continue hosting such content. The Platform may refuse, delay, remove, archive, or discontinue the availability of any content at its sole discretion, subject to applicable law.

16.10 Backup and Preservation

Users are responsible for maintaining their own backup copies of any User-Generated Content. Siliguri Circle does not guarantee that submitted content will remain available indefinitely and shall not be liable for the loss of content resulting from technical failures, account termination, policy enforcement, or other lawful actions.

16.11 Public Availability

Users acknowledge that User-Generated Content designated as public may be viewed, indexed, copied, shared, quoted, or referenced by other Users, search engines, and third parties, subject to applicable law and the Platform's Privacy Policy.

16.12 Reservation of Rights

Siliguri Circle reserves the right to establish additional content standards, moderation procedures, technical requirements, publication policies, and community guidelines governing User-Generated Content at any time in order to protect the integrity, security, and quality of the Platform.
